Summary | The Japanese national zoning system (i.e. use permit schedule) under the Building Standard Law only consists of "as-of-right" confirmation uses and "unpermitted" uses, and is said to be rigid but loose, whereas in North America exists a flexible system called "Conditional/Special Use Permit". Under an assumption that such American systems will afford us with some suggestions concerning the reorganization of the statutory planning and regulation systems in Japan, this study aims to investigate the situation and operation of Conditional/Special Use Permit Systems focusing on the actual decision criteria of the system, under which each case is judged. |
